Slip and Fall Incidents
The victim alleged that in November 2011, she was walking back to her vehicle at a Denton County gas station when she slipped and fell in the parking lot. She cited oil in the lot as the cause of her fall, which left her with severe injuries.
The case has now been settled, though the value of the settlement has not been made public. The victim sought damages to cover medical expenses, pain and suffering, physical impairment, disabling injuries and mental anguish.
Slip and Fall Injuries in Texas
Unfortunately, slip and fall cases, commonly referred to as ‘premises liability’, can prove difficult to authenticate in court. While a plaintiff may present a solid case, it is up to the jury to decide whether or not the property owner or manager was aware of a clear and present risk at the time of injury. There’s no doubt about it – when it comes to premises liability situations, you need your evidence to be 100 percent behind your claim.
Slip and fall accidents that occur on private property or business site may be eligible for additional financial damages. Such awards may be necessary in cases where growing medical costs, pain and suffering, or lost income become factors.
Although these types of accidents are quite common, it can be difficult to find qualified attorneys who handle these types of claims.
